Terms of Hire
Boat hiring requirements:
The vessel must be controlled at all times by the hirer (skipper). Recreational boats in the Northern Territory do not require a licence to drive, however a competency assessment will be carried out before the boat skipper is deemed competent by Gove Boat Hire to travel on their own. If the Gove Boat Hire representative deems the skipper is less competent, the said skipper is restricted to Gove harbour only. If the Gove Boat Hire representative deems the skipper incompetent, we reserve the right to cancel the hire. All other Territory marine and fishing licensing rules/regulations apply. The hirer will NOT allow any other person to control the vessel unless listed on the booking form and unless incapacitated to safely operate the boat. The nominated skipper is responsible for all occupants and their actions. Gove Boat Hire promotes responsible boating; ensure responsible alcohol consumption for both passengers and crew. It is Gove Boat Hire policy that the operator (skipper) of the boat remains under .05 BAC. Penalties apply if an incident occurs that is alcohol related. Not only will you be prosecuted by the police, you will also forfeit your bond and incur any other damage charges caused.
Boats must not be used for any illegal activity. If the boat is found to be used or suspect used for illegal activity the NT Police will be notified.
Operating hours and safety requirements:
Operating the vessel for daytime use is from 5am to 5:30pm. Night time 6:30pm until midnight. Should the said vessel not be returned by the said hours without meeting these conditions, the hirer’s bond will not be refunded. Boats are only to be operated in smooth waters, and this may include distances of operation. Suitable PFD, (lifejackets) for all passengers i.e. adult, juvenile, child will be provided. (Compulsory wearing of life jackets for children under 12 years at all times while on the water), please check territory regulations, however we recommend these be warn at all times while in the boat. Please be aware that children unable/too small to wear a PFD will not be allowed on the vessel.
It is required by the Australian Maritime Safety Authority that verbal contact via VHF Marine radio, satellite phone or mobile phone must be made to Gove Boat Hire – 0499 159 109 at the specified times of 10 am and 2pm on daily hires. For longer hires, communication times are 10 am, 2pm and upon anchoring for the night 6-7pm at latest. If hire is for night fishing, then contact shall be made when leaving and returning, and the times of contact to be agreed upon at the time of boat pick up. Failure to do so will result in loss of bond and incur a retrieval fee. Hirers are required to inform Gove Tackle and Outdoors/ Gove Boat Hire at the time of booking, their intended travel location so a satellite phone and EPIRB can be distributed on pickup. Any deviation from the informed travel itinerary (i.e. leaving Gove Harbour without contacting Gove Boat Hire) will result in forfeit of the bond. By signing this agreement, you understand and acknowledge that it is the responsibility of the hirer to ensure that a satellite phone is on board the vessel when venturing outside the Telstra mobile coverage area as indicated on the map. If the hirer does not possess their own satellite phone, one must be hired through Gove Boat Hire at $10 per day.
The vessel is not to operate in non-partially smooth waters (at sea) if the swell and wind waves exceeds .4 metres and if winds exceed 15 knots (exempt for estuary fishing where the boat is launched and retrieved in an estuary). The hirer must not operate the vessel in poor weather or sea/river conditions or where such conditions are imminent, if these conditions are present before the hire proceeds a transfer of reservation will be granted, however we do not grant such a transfer for rain alone. If a transfer of reservation is required and should the hirer wish to move their reservation to another day this needs to be agreed to by the existing location and a transfer fee of $30 will be applicable. Please refer to our website for bond and cancellation policies. By signing this agreement you acknowledge and agree to these policies.
Weather forecast monitoring is the responsibility of the hirer to ensure safety of persons on board the vessel.
Boundaries and requirements:
Vessels are not permitted to cross the red demarcation lines supplied on aerial maps and/or outside 1 nautical mile from any shoreline including islands. All persons on board are required to have a permit to enter aboriginal land which includes Dhimurru, Laynhapuy and Northern Land Council controlled recreational areas.
Boats are not to go within 100m of the export or cargo wharfs or travel through the access bridges. 100m clearance must to be maintained. Fines of up to $5000 apply.
Should the said vessel not be returned within the agreed time stipulated and the hirer is unable to be made contact with, it will be deemed the hirer to have lost/stolen the vessel and Gove Boat Hire will take steps to regain possession, including police action. An additional cost will be charged for a late return of $75 per hour if not prearranged. The hirer must pay penalty notices if issued by any Authority, occurring during the hire period. The hirer must pay for any damage or losses caused to the vessel/equipment/trailer during the hire period. The hirer is responsible for checking and ensuring that the tow vehicle has the correct trailer lights plug and that all lights and indicators work on the boat trailer.
Boat hire conditions:
You will receive the vessel with a full tank of fuel and you must pay to re-fuel the amount you have used i.e. re-fuel it to a FULL tank: TRAILER YOURSELF: The vessel must be returned with a full tank of fuel. If not returned full, fuel will be charged at cost plus 20% per litre for trailer yourself hires. WALK ON / OFF: Vessels will be refuelled by a Gove Boat Hire operator upon return, fuel is charged as per the pump price on the day.
The Hirer acknowledges and accepts that the use and operation of this vessel, including for the purposes of water skiing, swimming, towing a tube, and other such like activities, is subject to inherent risks and dangers. The Hirer accepts those risks and agrees to indemnify the Owner of the Vessel for any losses suffered by the Hirer, any passengers or any third parties as a result of the materialization of those risks and dangers. The Hirer also undertakes to advise all passengers of the risks and dangers associated with the use and operation of the vessel prior to boarding. The hirer acknowledges & understands all safety material and briefings that have been presented. We do not recommend any activity above, crocodiles inhabit all NT coastal areas and estuaries which if attacked can cause very serious injury or death.
The hirer acknowledges that they have read, understood and agree to be bound by the terms and conditions of this rental agreement and have made themselves familiar with both the location and content of the safety management plan and understand this. The hirer is responsible for all occupants complying with all conditions. Any costs incurred to Gove Boat Hire will come out of the hirer’s bond, and if exceeds the bond amount, an invoice will be issued to the hirer.
Confirmation and sighting of the hirer’s identification will be required.
Night time operation conditions and declaration:
Navigating at night takes special care. It is essential that you can see other boats and they can see you, remember it is difficult to judge distances at night, not all navigational hazards will have light indicating their position; and background light from the shore can cause confusion, so always slow down and keep a constant look out. These night time conditions are in conjunction with the standard Gove Boat Hire conditions; the vessel is not permitted to be used for night time operation unless the following conditions are met:

The hirer must inform Gove Boat Hire where they are going and not deviate from there intended destination.
Navigation lights must be used, including navigation lights must remain on while at anchor
No camping on the boat at any time.
Should the said vessel be used at night without meeting these conditions and signing this declaration, the hirer’s bond will not be refunded.
New Year's Eve Bookings:
All New Year's Eve bookings require a 2 day hire minimum. For further information, please contact the Gove Boat Hire team on 0499 159 109.
You have now received your booking confirmation and your boat hire has been allocated, should you wish to make any changes to your booking the following conditions apply:
Single day/night hires cancelled by the customer within 24 hours of hire – full hire amount forfeited unless unforeseen circumstances are proven.
Multiple day hires reduced/cancelled within 5 days of hire – hire payment forfeited for length of booking (ie if booking is for 3 days at $200 amount forfeited would be $600)
Bad weather policy:
If Gove Boat Hire deems the conditions to be unsafe and/or unsuitable for use the total hire fee will be refunded or you may wish to pick another date when weather conditions are more suitable.
